Play All Day App User Terms

Welcome to the Play All Day App. These terms of service ("Terms") govern your use of the Play All Day app and website provided by Team Play All Day Pty Ltd ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please discontinue using our services immediately.

1. Eligibility

By registering an account or using the Play All Day app, you confirm that you are 18 years or older, or you are using the app under parental or guardian supervision. We reserve the right to modify, update, or remove features of the app at our discretion. Continued use of the app after such modifications will constitute your acceptance of any changes.

4. Prohibited Use of the App

You agree not to use the Play All Day app for any unlawful or unauthorised purposes, including but not limited to:
- Attempting to gain unauthorised access to any systems, networks, or accounts associated with the app.
- Violating any applicable laws, including privacy or export control laws.
- Reverse engineering, decompiling, or attempting to extract the source code of the app.
- Scraping or data mining content from the app.
- Posting harmful, fraudulent, or objectionable content.
- Harassing, abusing, or attempting to exploit other users or minors using the app.

5. User Conduct and Safety

You are solely responsible for supervising children's use of the app and ensuring that they follow the safety guidelines provided. You agree to take full responsibility for any damages or injuries that occur during the use of the app's activities.

6. Intellectual Property

All content provided on the Play All Day app, including but not limited to text, images, graphics, and software, is owned by Team Play All Day Pty Ltd and is protected under intellectual property laws. Users are granted a limited, non-exclusive license to access and use the app for personal, non-commercial purposes. Reproduction, modification, distribution, or storage of any app content is prohibited without prior written consent from Team Play All Day Pty Ltd. By submitting content to the app, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content for the purposes of providing and promoting the service. However, we will not modify your content in a manner that alters the original meaning or intent without obtaining further consent from you. We will ensure that any modifications remain consistent with the purpose of delivering the app’s services and promoting the platform.Users retain ownership of their content, and they may revoke the license at any time by removing their content from the app or by contacting us in writing. Revoking the license does not apply to content already used in previous promotions or marketing materials, but future use of the content will cease upon revocation.

7. Payment and Subscription (if applicable)

If the Play All Day app offers premium services or subscription-based content, you agree to pay the fees associated with those services. Payments will be processed through a third-party payment processor, and we do not store your payment details on our servers. 9. Limitation of Liability

To the fullest extent permitted by law and subject to your rights under the Australian Consumer Law (ACL), Team Play All Day Pty Ltd and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, goodwill, or business interruptions resulting from your use of the app, even if advised of such possibilities.
In situations where liability is determined beyond these limitations, our total liability will not exceed the greater of AUD 100 or the total fees you have paid us in the six months preceding the incident giving rise to the claim. We are not liable for issues arising from third-party services, including payment processors, or for actions taken in response to violations of these Terms.

10. Dispute Resolution and Governing Law

The laws of Australia govern these Terms, and any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia. We encourage users to attempt to resolve disputes through mediation before seeking legal action, to facilitate amicable resolutions.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. If changes are made, we will provide at least 30 days' notice before the changes take effect, unless required by law. Changes will be posted on our website or communicated via email. By continuing to use the app after such updates, you agree to the updated Terms.
